Are You Entitled To Workers' Compensation Benefits?

The Pennsylvania Workers' Compensation Act requires an employer to provide benefits for all injuries that occur in the course and scope of employment. An employee is not required to show that the employer was at fault in causing the injury, only that the injury is causally related to his or her work. An "injury" also includes an aggravation of a prior injury or non-work related condition.

Prompt reporting of a work injury to your employer is extremely important. A delay in notifying your employer of your injury can make you ineligible for benefits. An accident and injury report, which is filed with the Pennsylvania Bureau of Workers' Compensation should be completed as soon as possible. If your injury causes you to lose wages or time from work, you may be entitled to wage loss benefits. How much you receive in wage loss benefits is determined by your earnings both at the job where you were injured, and any other employment you have at the time of injury. Your employer is also required to pay for reasonable and necessary medical treatment related to your work injury. You can also receive additional benefits for certain types of scarring and loss of use to the body. Written documentation should be received within 21 days after your injury is reported, indicating whether or not your employer or their insurance carrier has accepted your claim.

What If Your Workers' Compensation Claim Is Denied?

It is not uncommon for a claim for workers' compensation benefits to be denied, for a variety of reasons. If that occurs, it may become necessary to file a Claim Petition, and litigate your case. This usually involves taking deposition testimony from your physician or other medical providers,
